Excerpt from Civil Procedure at Common Law Authors on code procedure In the United States usually advise students commencing its study to first familiarize themselves with the principles of common law as well as equity procedure. As an instructor for ten years in code, common law, and equity procedure, I have been impressed with the truth and propriety of this advice, and have endeavored to make it as effective as possible, in the instruction which it has been my duty to impart. I would not be understood as urging the student of code procedure to achieve that critical mastery of the common law system of procedure, which was a necessary accomplishment of a successful barrister; but that he should acquire such passable knowledge of its history and principles as will enable him to understand thoroughly the reformed system which has supplanted it. All the more necessary is such knowledge to the student of the modified systems of common law procedure which prevail in some of the States. The work which I now submit to the profession has boon prepared during the years in which I have been engaged as an instructor in civil procedure, with the view of meeting- the requirements of the modern student in law for a more thorough and extended acquaintance with the common law system of procedure. It has been prepared more especially for students, and is written from the standpoint of an instructor, who commenced to practise as an attorney under the system which he is now engaged in teaching.
