Prosecuting Domestic Abuse in Neoliberal Times available in PDF, EPUB and Kindle. This book argues that past inattentive treatment by state criminal justice agencies in relation to domestic abuse is now being self-consciously reversed by neoliberal governing agendas intent on denouncing crime and holding offenders to account. Criminal prosecutions are key to the UK government’s strategy to end Violence Against Women and Girls. Crown Prosecution Service policy affirms that domestic abuse offences are ‘particularly serious’ and prosecutors are reminded that it will be rare that the ‘public interest’ will not require of such offences through the criminal courts. Seeking to unpick some of the discourses and perspectives that may have contributed to the current prosecutorial commitment, the book considers its emergence within the context of the women’s movement, feminist scholarship and an era of neoliberalism. Three empirical chapters explore the prosecution commitment on the one hand, and the impact on women’s lives on the other. The book’s final substantive chapter offers a distinctive normative conceptual framework through which practitioners may think about women who have experienced domestic abuse that will have both intellectual appeal and practical application.

This book offers a timely and detailed examination of the reality of criminal legal practice today. Drawing upon extensive anonymous interviews with criminal lawyers in England and Wales, it illuminates how financial pressures arise within the criminal justice system and how lawyers seek to navigate them. The work of criminal lawyers is frequently depicted in the news and media as exciting, well-paid and worthwhile, with prosecutors aiming to convict the guilty and defence lawyers fighting against miscarriages of justice. In contrast, the picture reported by many is of an already creaking and under-resourced system, now exacerbated by fallout from the COVID-19 pandemic. Against this backdrop, the book considers whether the criminal legal aid system really can continue to provide those unable to afford a lawyer with access to justice and whether the Crown Prosecution Service can provide justice to victims of crime. The book presents detailed findings about the work and experiences of both prosecutors and defence lawyers, how financial pressures influence this and to what extent this has changed with the new ways of working brought about by the COVID-19 pandemic.

Drawing on experiences from other jurisdictions within the UK, Criminalising Coercive Control explores the challenges and potential successes which may be faced in implementing Northern Ireland’s new domestic abuse offence. A specific offence of domestic abuse was introduced in Northern Ireland in March 2021. This represents a crucial development in Northern Ireland’s response to domestic abuse. The new legislation has the effect of criminalising coercive and controlling behaviour, thereby bringing Northern Ireland into line with other jurisdictions within the UK, and also with relevant human rights standards in this regard. The book begins with a discussion regarding the offence itself and the underpinning domestic abuse policy in Northern Ireland. Subsequent chapters explore further measures which may be needed to respond effectively to domestic abuse in Northern Ireland, by drawing upon the experiences of other jurisdictions of criminalising coercive control. These reflections are considered through the lenses of policing, prosecutorial practice and frontline domestic abuse working. Criminalising Coercive Control will be of great interest to students and scholars in a variety of fields, such as criminal law, criminology, social policy, human rights, family law, gender studies and sociology. The book is also accessible beyond academia, including practitioners and those in the voluntary sector who are working in the area of combating domestic abuse.
