Emerging surveillance technologies used by governments, corporations, and even individual members of the public are reshaping the very nature of physical public space. Especially in urban environments, the ability of individuals to remain private or anonymous is being challenged. Surveillance, Privacy, and Public Space problematizes our traditional understanding of ‘public space’. The chapter authors explore intertwined concepts to develop current privacy theory and frame future scholarly debate on the regulation of surveillance in public spaces. This book also explores alternative understandings of the impacts that modern living and technological progress have on the experience of being in public, as well as the very nature of what public space really is. Representing a range of disciplines and methods, this book provides a broad overview of the changing nature of public space and the complex interactions between emerging forms of surveillance and personal privacy in these public spaces. It will appeal to scholars and students in a variety of academic disciplines, including sociology, surveillance studies, urban studies, philosophy, law, communication and media studies, political science, and criminology.

This book examines privacy in public space from both legal and regulatory perspectives. With on-going technological innovations such as mobile cameras, WiFi tracking, drones and augmented reality, aspects of citizens’ lives are increasingly vulnerable to intrusion. The contributions describe contemporary challenges to achieving privacy and anonymity in physical public space, at a time when legal protection remains limited compared to ‘private’ space. To address this problem, the book clearly shows why privacy in public space needs defending. Different ways of conceptualizing and shaping such protection are explored, for example through ‘privacy bubbles’, obfuscation and surveillance transparency, as well as revising the assumptions underlying current privacy laws.

The purpose of this paper is to assist law enforcement, lawmakers, and the broader public in understanding and protecting our fundamental right to privacy with respect to surveillance by the state of our activities in public spaces through the use of ever-growing new technologies. [...] Like its antecedent in the Fourth Amendment to the U. S. Bill of Rights, the constitutional concept of security that animates section 8 of the Charter was born of "the conviction that certain kinds of searches and seizures [are] intolerable."17 Today, both section 8 of the Charter and the Fourth Amendment recognize that everyone has a right to be secure against the use of unreasonable state powers [...] It would, however, enhance the ability of targeted individuals to identify and challenge invasions to their privacy and seek meaningful remedies.33 As the deadline for complying with the Court's order to ensure notice loomed, Parliament passed Bill C-55, the Response to the Supreme Court of Canada Decision in R. v. Tse Act.34 Not only did the bill amend the Criminal Code to provide that a person w [...] If the state chooses to engage in that kind of invasive conduct, it must be able to meet the constitutional requirements of s. 8. ... [W]hile the public nature of the forum in which an activity occurs will affect the degree of privacy reasonably expected, the public nature of the forum does not eliminate all privacy claims. [...] Depending on the totality of the circumstances, [a person's] anonymity may enjoy constitutional protection under s. 8 [of the Charter]."40 In this context, the Court affirmed that the right to privacy includes the concept of "public privacy." In particular, the Court's reasoning clarified that public privacy is the right to seek and find freedom from identification and surveillance with respect to.

The digital age is also a surveillance age. Today, computerized systems protect and manage our everyday life; the increasing number of surveillance cameras in public places, the computerized loyalty systems of the retail sector, geo-localized smart-phone applications, or smart traffic and navigation systems. Surveillance is nothing fundamentally new, and yet more and more questions are being asked: Who monitors whom, and how and why? How do surveillance techniques affect socio-spatial practices and relationships? How do they shape the fabrics of our cities, our mobilities, the spaces of the everyday? And what are the implications in terms of border control and the exercise of political power? Surveillance and Space responds to these modern questions by exploring the complex and varied interactions between surveillance and space. In doing so, the book also advances a programmatic reflection on the very possibility of a ‘political geography of surveillance’.

Why is public space disappearing? Why is this disappearance important to democratic politics and how has it become an international phenomenon? Public spaces are no longer democratic spaces, but instead centres of private commerce and consumption, and even surveillance and police control. "The Politics of Public Space" extends the focus of current work on public space to include a consideration of the transnational - in the sense of moving people and transformations in the nation or state - to expand our definition of the 'public' and public space. Ultimately, public spaces are one of the last democratic forums for public dissent in a civil society. Without these significant central public spaces, individuals cannot directly participate in conflict resolution. "The Politics of Public Space" assembles a superb list of contributors to explore the important political dimensions of public space as a place where conflicts over cultural and political objectives become concrete.
