Until the late 20th century, ‘an archive’ generally meant a repository for documents, as well as the generic name for the wide range of documents the repository might hold. An archive could be visited, and then also searched, to discover past actions or lives that had meaning for the present. While historians and historiographers have long understood the contests that archives contain and represent, the very idea of ‘the archive’ has, over the last 40 years, become the subject and object of widening and intensified consideration. This consideration has been intellectual (from scholars in a wide range of disciplines) and public (from communities and individuals whose stories are held captive, or sometimes hidden or excluded from official archives), as well as institutional. It has involved scrutiny and critique of official archives’ limitations and practices, as well as symbolic, affective and theoretical expansion and heightened expectation of what ‘the archive’ is or should be. The very language of ‘the archive’ now carries freight as administrative practice, normative value, metaphor, description and aspiration in different ways than it did in the 20th century. This collection offers a unique contribution to these reinvigorated and sometimes new conversations about what an archive might be, what it can do as a consequence, and to whom it bears custodial responsibilities. In particular, this collection addresses what it means for contemporary Australian superior courts of record to not only have constitutional and procedural duties to documents as a matter of law, but also to acknowledge obligations to care for those materials in a way that understands their public meaning and public value for the Australian people, in the past, in the present and for the future.

The enduring interest displayed by many readers in the character of China's great Empress Dowager Tzŭ Hsi, and the generous appreciation accorded to our work on her life and reign, have prompted the belief that the present work, covering a wider stretch of space and time, should prove interesting, and of some value, to those who desire to study the causes, immediate and remote, of recent and current events in the Far East. Until we understand something of the mainsprings of thought and action which determine the governance and daily life of a people-something of their atavistic memories and instincts, of their social, religious and economic systems, it is not possible to sympathise with them in their perils and crises of change, or to render them the assistance which appreciation of their motives and intelligent anticipation of their needs might supply. -- Introduction.

The Texas Supreme Court available in PDF, EPUB and Kindle. “Few people realize that in the area of law, Texas began its American journey far ahead of most of the rest of the country, far more enlightened on such subjects as women’s rights and the protection of debtors.” Thus James Haley begins this highly readable account of the Texas Supreme Court. The first book-length history of the Court published since 1917, it tells the story of the Texas Supreme Court from its origins in the Republic of Texas to the political and philosophical upheavals of the mid-1980s. Using a lively narrative style rather than a legalistic approach, Haley describes the twists and turns of an evolving judiciary both empowered and constrained by its dual ties to Spanish civil law and English common law. He focuses on the personalities and judicial philosophies of those who served on the Supreme Court, as well as on the interplay between the Court’s rulings and the state’s unique history in such areas as slavery, women’s rights, land and water rights, the rise of the railroad and oil and gas industries, Prohibition, civil rights, and consumer protection. The book is illustrated with more than fifty historical photos, many from the nineteenth and early twentieth centuries. It concludes with a detailed chronology of milestones in the Supreme Court’s history and a list, with appointment and election dates, of the more than 150 justices who have served on the Court since 1836.

In this electrifying bestseller, the shrewd and voluble trial lawyer Louis Nizer, who made a long career of representing famous people in famous cases, recounts some of his significant civil and criminal cases. Nizer rose to national fame with his real-life accounts of tension-filled courtrooms and the fervor of the advocate, and “My Life in Court” proved to be no exception: it rose to the top of the Times’s best-seller list on its publication in 1961 and logged 72 weeks as a sales leader. The book is an in-depth collection of some of Mr. Nizer’s court case success stories, including his client Quentin Reynolds’ famous libel action against the columnist Westbrook Pegler, which would also become the basis of the 1963 Broadway play “A Case of Libel.” Praised by critics as “entertaining and philosophically instructive, an unusual combination,” Nizer’s movie-like plots of real-life courtroom drama will keep you captivated until the very last page.
