Seminar paper del año 2012 en eltema Derecho - Derecho público / Otros, , Idioma: Español, Resumen: Este proyecto se inspira en la metodología de confrontación adoptada por el autor Carlos Giménez Romero en su artículo disponible en internet “Modelos de Mediación y su aplicación en Mediación intercultural”, lo cual me motivó a hacer esta aproximación sectorial aplicada al conflicto alimenticio. Para realizar el presente estudio metodológicamente comenzaremos con una somera descripción jurídica del derecho de alimentos, sujeto a una doble delimitación: circunscrito sólo a los alimentos legales y dentro de estos sólo aquellos establecidos en el Código Civil, utilizando como fuente principal de información la obra del autor René Ramos Pazos “Derecho de Familia” tomo II. Realizada la descripción y antes de avocarnos a los modelos de mediación, se procederá a describir desde la perspectiva sociológica que proporciona la Teoría del Conflicto, la naturaleza y características generales de las divergencias que se suscitan a propósito de este derecho, previniendo eso sí, que aún cuando reconocemos que la dinámica conflictual en materia de familia es compleja, para efectos de este ensayo buscaremos circunscribir el tema sólo al problema de los alimentos. Posteriormente se realizarán una somera exposición de cada uno de modelos de mediación señalados, mencionando sus fundamentos teóricos y describiéndose las principales características de cada modelo para lo cual nos apoyaremos en el marco que proporciona la autora Marines Suarez en su obra. “Mediación. Conducción de disputa, comunicación y técnicas.”(1996). En la etapa descriptiva de cada modelo nos aproximaremos sobre la conveniencia de aplicarse para solucionar el conflicto alimentario. Posteriormente, a modo de síntesis conclusiva se confrontarán los modelos, especialmente en relación a nuestras apreciaciones sobre los beneficios y limitaciones de cada uno, realizado lo cual.
