Iran dispute around the sovereignty over the Persian Gulf islands of Abu Musa, Greater Tunb, and Lesser Tunb according to the rules of international law governing title to territory. The aim is to provide a legal assessment over the ownership of these islands which comprise the most intractable dispute in the region. Following such analysis, the three islands were found to belong to Iran Legal settlement of the conflict was resorted to in this study given the development in legally binding focus of third-party dispute settlement such as the WTO, the International Maritime Court, the International Criminal Court (ICC), as well as an increase in the use of the International Court of Justice (ICJ). However, the majority of inter-Arab territorial conflicts have not been resolved through legal channels. States are generally reluctant to submit their disputes to third-party settlement due to its binding character and no right of appeal. This is especially the case when the dispute involves issues of state sovereignty and territoriality as the Abu Musa and Tunbs dispute. Moreover, the interplay of politics, economics, geo-strategy, environment, nationalism, symbolism, and psyche in this dispute hinders its legal settlement and makes it difficult to achieve any other prospect for settlement in the foreseeable future. At the same time, legal settlement is only resorted to after both parties have exhausted all the peaceful methods of dispute resolution and have reached an impasse over the issue. Therefore, all these elements combined suggest bilateral negotiations followed by mediation as the best mode of settlement for the Abu Musa and Tunbs dispute.
